Case study 03
An investor sought to recover more than AED 6.4 million and to rescind an investment agreement. The claim failed on the claimant's own obligations.
An investor brought a claim against several individuals and companies, seeking to recover more than AED 6.4 million and to rescind the investment agreement that governed the relationship.
We read the agreement against what each side had actually done under it.
The defence turned on obligations the claimant had taken on himself and had not performed, which the correspondence and the payment record established without needing to dispute his account of events.
The Court dismissed the claim in its entirety and ordered the claimant to bear the court costs and legal fees.
