Criminal Defence

Advice on criminal complaints and investigations, and instruction of a registered advocate where representation is required.

The most consequential decisions in a criminal matter are usually taken in the first days, often before anyone has seen a lawyer, and frequently at the police station.

Criminal liability in the UAE is governed by Federal Decree-Law No. 31 of 2021 on Crimes and Penalties, which replaced Federal Law No. 3 of 1987 and came into force on 2 January 2022. It classifies offences as felonies, misdemeanours and infractions. A complaint is filed with the police station for the area where the offence is said to have occurred, and the file is referred to the Public Prosecution, which alone decides whether charges follow.

We advise at that stage: what the complaint actually alleges, what the documentary record supports, and what a statement given now will mean later. Appearing before the criminal courts is reserved to registered advocates. Where a matter reaches that point we prepare the file and instruct one, and we say so at the outset rather than once it is unavoidable.

Questions we are asked

What happens after a complaint is filed?

A complaint is filed with the police station for the area where the offence is said to have occurred. The police take statements and refer the file to the Public Prosecution, which alone has the right to bring charges, conduct the investigation and carry the matter to judgment.

What should I do if I am accused of a crime in Dubai?

You should seek legal advice immediately and avoid making statements without consulting a criminal defense lawyer.

What is the difference between the police stage and the Public Prosecution?

The police take the initial complaint and statements. The Public Prosecution decides whether a charge follows, directs the investigation and may order precautionary measures such as a travel ban. What is said at the police stage forms part of the file the Public Prosecution reads.

Which law governs criminal offences in the UAE?

Federal Decree-Law No. 31 of 2021 on Crimes and Penalties, in force since 2 January 2022, which replaced the 1987 Penal Code. It classifies offences as felonies, misdemeanours and infractions. Procedure is governed separately by the Criminal Procedures Law.

Can a company be the subject of a criminal complaint?

Yes. Complaints involving alleged fraud, breach of trust or regulatory breaches are commonly directed at a company and at named individuals within it, which is why the two positions need assessing separately at the outset.

Are consultations with criminal defense lawyers confidential?

Yes, all legal consultations are handled with strict confidentiality and professional ethics.

Do you represent clients in the criminal courts?

Rights of audience before the UAE courts are reserved to registered advocates. We provide advisory support and, where a matter requires representation, we instruct and work alongside a registered advocate. We tell clients which of the two their matter needs at the first meeting.

What should I do if a complaint has been filed against me?

Take advice before giving an account. Statements made early are difficult to qualify later, and the documentary record that supports your position is usually best assembled before rather than after.
